Terms of Service

​By purchasing my services, you automatically agree to the following conditions. Please read this entirely and carefully. I will refuse service if you do not agree to these terms. If you have any questions, please contact me.

1. PAYMENT

All payment is due before I begin work on your project, unless otherwise agreed upon via contract for larger projects.

All payments are received via PayPal.

I do not accept payment from shared PayPal accounts, minors using a parent's PayPal, or accounts with no standing.

Once I start your commission, I cannot refund you the full amount. This is negotiable depending on individual details. Because of PayPal fees, taxes and transfer fees, I can only refund 80% if by client's fault. If I cancel a project however I will reimburse the lost fees and refund 100%.

After project is complete and sent to the client, I will not refund any amount for the works.

Pricing differs between projects depending on what the commissioner is asking for- the dollar amount shown on my portfolio is simply the base starting amount.

All prices are negotiable and will be discussed before the project is started. If a payment plan is needed, we can discuss a contract to ensure protection for both parties involved.

2. CHARGE-BACKS

If for some reason your PayPal account is not working, or authorizes a refund request without you knowing somehow, you must contact me as soon as possible in order to resolve the issue.

Issuing a charge-back without contacting me to cancel/refund a project will result in immediate blacklisting for you, your email address, and anyone sharing your PayPal account, including side accounts.

Please do not ever issue a charge-back through PayPal.

3. ARTIST

By commissioning me, you are purchasing my service as an artist/programmer only. I retain all copyrights over my work, which include but are not limited to the right to redistribute, reproduce, or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

I will respect your request for privacy if you'd prefer me not to post your project publicly. Discuss with me prior to starting.

I will not claim the Intellectual Property or reuse/resell your project/design for personal or commercial projects unless agreed upon.

I reserve the right to decline any project or client for any reason without questions*. This includes clients who have not read these terms.

I reserve the right to use rejected sketches for any future project, be it personal or otherwise.

4. CLIENT

The client may display my work on external sites as long as it is visibly credited and linked back to me. You may not, however, upload or host my work in any gallery that is intended for your own work only (i.e. deviantart, toyhouse, furaffinity, ect.) Once a piece has been commissioned, You may use it for personal uses, including but not limited to signatures, icons, avatars, layouts, wallpapers, themes, and personal page/site displays.

You retain rights to the Intellectual Property.

You may not claim the work to be your own or the work of anyone besides me.

You may not edit it the artwork itself without permission.

You may not set it up for redistribution, external projects, commercial or non-commercial. (i.e. t-shirts, mugs, public flyers, ect) unless agreed upon in a contract.

This applies to adoptable designs and websites as well.

I do not recognize co-ownership and I will not intervene in any ownership disputes.

5. CLIENT IN REGARDS TO 'ADOPTABLE' DESIGNS

You may gift or trade design to another person at any time.

You may resell a design for the price you purchased it for, though you may add additional cost to design to recoup revenue spent on additional art.

Do not trade/gift/sell designs to people who are on blacklists/have payment issues/use a shared PayPal account.

6. PROCEDURE

Clients are expected to first read my T.O.S. before commissioning me for anything.

Once you’ve read the T.O.S., you can then contact me regarding your proposed project, revealing any details including but not limited to: your proposed budget, size specifics, desired colors/details/accessories, any possible time constraints, ect.

After a price is agreed upon and I receive Payment I will begin work on your project, providing you with project updates and sketches periodically to ensure I am properly meeting your requirements.

Please be available to provide feedback during this time. If you cannot/don't want to provide feedback, I will not be responsible for misunderstandings regarding the finished design.

You may request minor changes during all stages, larger changes will incur a fee depending on how much is changed. I will not change the art to something completely different once I have started digitizing the art.

Please always be clear when giving details or asking for changes. Use of example images, palettes and gallery examples is encouraged!

7. WEBSITES

All website commissions will be set to a contract. Before entering into the contract, I will need to know everything you want included in the website including but not limited to: estimated number of pages, website features, client-side functions, design, layout, etc.

You can request changes throughout the entire process of the website’s development, however any larger changes or large additions that were not specified in the contract will be added to an amended contract and have that added to the total price for the website.

I do not do website maintenance once the website is done- however if client needs someone to manage the website after it’s completed, we can work out a long term contract and pricing for my continued maintenance.

You do not have permission to redistribute my code to anyone else except whomever you, the client, has asked to be included in the contract.

The use of a contract is non-negotiable.

*CONTENT

For my own protection, I do not list every possible theme/content that I will refuse, however please note that;

- I do not draw NSFW art at all, not even a private naked version for client only. If you commission me for a ref sheet, character will be wearing underwear at least.

- I will not draw things against my beliefs or anything illegal or hateful.

- I retain the right to decline any project from any client for any reason at any time without having to provide a reason or enter a dispute with them.

By commissioning me you agree to these terms- even if you have not read through them. Please include as much information as possible when commissioning me, the more details the better! And always ask questions if you aren’t sure so we can avoid any misunderstandings!

I retain the right to edit this document at any time and for any reason.
